The Ninth Circuit Connection

Although no United States District Judge for the Eastern District of California has ever been elevated to the Ninth Circuit, in the history of the Court of Appeals four judges have been appointed from the geographical area presently comprising the Eastern District of California. Before the district was created in 1966, United States District Judge Dal M. Lemmon, of Sacramento, was elevated the the Ninth Circuit in 1954, and United States District Judge Gilbert H. Jertberg, of Fresno, was elevated in 1958. After formation of the district, Sacramento lawyer Anthony M. Kennedy was appointed as a Circuit Judge for the Ninth Circuit in 1975. Most recently, former Justice Connie M. Callahan of the Third District Court of Appeal of California was appointed to the United States Court of Appeals for the Ninth Circuit on May 22, 2003.
